          It is interesting to note that Thomas Kelsall is said to be of the
Parish  of  Liverpool at the time of his application for a marriage Licence,
in view of later Family connections with that City.

          I  have traced this marriage of Thomas Kelsall (1799  -  1839)  to
Letitia  Pinchers  in St.Oswald's Parish Church Chester on 1st July 1824:

          I  have located Thomas's grave in the Cathedral grounds at Chester
which gravestone states:

7) Will and Testament:

          Thomas's   Will  is of interest in confirming the name of Thomas's
only  known  survivng  child, his daughter Elizabeth and that of his brother
John. I assume that as John was one  of  the  executors  it  was  a  natural
consequence that on the death of Letitia in 1847 Elizabeth should be offered
a home in Liverpool with her uncle John and his family.

          This is the last Will and Testament of me Thomas  Kelsall  of  the
          City  of  Chester Fishmonger I give and bequeath unto my dear Wife
          All my Household Furniture Plate Linen and China together with  my
          Horses  Carts and Carriages and all other my Utensils in Trade for
          and during the term of her Natural life And as  to  all  my  ready
          money  money  out at Interest Book debts and all other my personal
          Estate of what nature or kind soever I Give and bequeath the  same
          unto my Brother John Kelsall and to William Edwards a Clerk in the
          Town Clerks Office Chester Upon Trust to collect and get in all my
          outstanding  debts  and do and shall pay all my just debts funeral
          and Testamentary expenses in the first place and as to the residue
          of my said personal Estate Upon Trust to place  the  same  out  at
          interest  either  in  the  Parliamentary  Stocks or Funds of Great
          Britain or on Real or personal security as they my  said  Trustees
          shall  seem  best  and  do and shall alter vary and Transpose such
          Stocks Funds or other securities for Others of a like Nature  when
          and  as often as the same shall be necessary or requisite. And the
          Interest and dividends do and shall from time to time as the  same
          shall  from  time  to time become due and be received pay the same
          unto my said dear Wife for and during the term of her Natural life
          and from and after her decease I Give and  bequeath  all  my  said
          Household  Furniture Plate Linen and China and all the said Trusts
          monies unto my Daughter Elizabeth to be paid and payable to her on
          her attaining her age of Twenty one years But if my said  Daughter
          Elizabeth  shall depart this life under the said age of Twenty one
          years and without leaving lawful Issue Then I  Give  and  bequeath
          the  said  Household  Furniture  Plate Linen and China and all the
          said Trust monies unto among  and  between  all  my  Brothers  and
          Sisters  and  the  Children  of  my  late Brother William in equal
          shares share and share alike I Give and  bequeath  my  Gold  Watch
          unto  my daughter Elizabeth for her own use and benefit And lastly
          I do direct my said Trustees and the  survivor  of  them  and  the
          Executors  and  Administrators  of  such  Survivors  shall  not be
          charged with any more of my Estate and Effects than shall actually
          come to their respective hands neither shall  they  be  liable  or
          accountable one for the other but each of them for himself and for
          his own acts deeds and defaults And I do direct that  in  case  my
          said daughter shall survive my said Wife it shall be lawful for my
          said Trustees and the Survivor of them to lay out such part of the
          interest  of the said Trust monies for and towards the maintenance
          and education of my said Daughter until she arrive at the  Age  of
          Twenty  one  years  And  I  do hereby nominate and appoint my said
          Brother John and the said William Edwards  Executors  of  this  my

          One further thought about this Will is the nomination  of  William
Edwards  as  an  executor. If there is a link between our Family and that of
the Family shown on the 1820's Pedigree, it is an interesting possibility to
consider whether the William Edwards here is a relation of the Sarah Edwards
who married Thomas Kelsall at Stoke on January 19th 1778.

          Apart from the reference in the I.G.I. to Sarah's baptism and  the
Staffordshire Burial Index's reference to the burial of one Sarah Kelsall in
1818,  nothing  is  known  of  this or indeed any other daughter of John and
Elizabeth Kelsall. There is good reason for stating that there were at least
two daughters who survived Sarah as  the  Will  of Thomas  Kelsall  (1799  -
1839)  gives  a  bequest  of his  residuary  estate  to "all my Brothers and
Sisters and the Children of my late Brother William..."

          If  this is a reference to our Sarah, then it is also a pointer to
the whereabouts of the Family in June 1818, namely Burslem. This presents  a
problem  insofar  as  the  apparently  undisputed fact that her Parents were
living in Shelton and Hanley in later years, and both apparently died whilst
living in Hanley. Sarah's brother Richard, however, did have his business in
Burslem and, of course, all his family were baptised in either St.John's  or
St.Paul's  Parish Churches. Other family connections seem to be more Shelton
and Hanley than Burslem.

The Chronology of Family events appears to be:

          Richard Kelsall was married twice; his first marriage to Jane Ward
of Brewood near Wolverhampton proved tragically short as she died  in  1833.

          Elizabeth's mother, Jane, had died in December 1833,  which  was
reported in the Staffordshire Advertiser:

          If  for  no other reason than the substantial gap between the date
of  marriage and the date of Elizabeth's baptism, I would suggest that other
child or children were born to Richard and Jane  but,  so  far,  I  have  no
evidence to support this assertion.

          Richard Kelsall  then  married  one  Ann  Kettle,  who  came  from
Middlewich  Cheshire,  on  15th  September 1834 at St.Peter's Parish Church,
Stoke,

          Richard and Ann's  first  son, John, appears to have been baptised
twice, firstly on the 3rd August 1835 and then again, a little under a  year
later  on the 26th June 1836.  This "double baptism" is repeated for Ann who
is shown as being baptised on the 13th March and  again  on  the  26th  June
1842.

          It  is interesting to note  that  the boys were born in succession
followed by the girls; the boys were baptised at  St.Paul's  Church  whereas
the girls were baptised at St.John's Church, both in Burslem.



          On visits to Stafford County Record Office and  Hanley  Library  I
discovered  confirmation  that  2  daughters of Richard  and  Ann  had  died
young;  Ann  (baptised  26th  June  1842)  and  an older Sarah (baptised 8th
February 1846).  the Burial Register for St.John's, Burslem  Church  records
the following burials:

 Sarah Kelsall  Queen St.   Feb 4th [aged] 2yrs 10mo.
 Ann   Kelsall  Queen St.   Feb 6th [aged] 7yrs.

          I  think  it  most  likely  that  the girls died in an outbreak of
Cholera, epidemics of which took many lives in 1849, 1852-54 and  1856.  and
is  again  corroborated  in  a  negative way by the gravestone in St.John's,
Burslem which is damaged as the inscription reads:

          Ann  Kelsall  died  intestate,  but when Richard died in 1871, his
Will was proved and Probate was granted to his sons:

WILL:

          This is the Last Will and Testament
          of  me  Richard  Kelsall  of  Burslem  in  the  County of Stafford
          Fishmonger  First  I  direct  all  my  just  debts   funeral   and
          testamentary  expenses  to  be paid as soon as conveniently may be
          after my decease out of my personal  estate.  I  give  devise  and
          bequeath  unto  and  to  the  use  of  my  trustees  and executors
          hereinafter named and the survivor of them and the  executors  and
          administrators  of  such survivor and their and his assigns all my
          real and personal estate whatsoever and wheresoever  situate  upon
          the  trusts  and subject to the declarations following namely Upon
          trust immediately after my decease to sell dispose of collect  get
          in  and  convert  into  money  as well all my said personal estate
          including my business as Fishmonger  and  any  other  business  in
          which I may be engaged at the time of my decease as also the house
          shop  and  premises  in  which  I  now reside situate in Queen St.
          Burslem  aforesaid  Upon  trust  to  invest  the  monies   arising
          therefrom  in  or  upon  the  public  stocks  or funds or on first
          Mortgage of real property in England with power from time to  time
          to  vary  such  investments  And upon further trust to receive and
          stand possessed of the dividends and annual  income  arising  from
          such  investments  as  aforesaid and also the rents and profits of
          all other my real estate Upon trust out of the same to pay to each
          of my two daughters Martha and Sarah  the  sum  of  ten  shillings
          weekly  so  long  as  they  shall respectively be under the age of
          twenty one years and unmarried  And  after  the  majority  of  the
          younger  of my said two daughters Martha and Sarah or the marriage
          of both my said daughters whichever may first happen Upon Trust to
          sell and dispose of all my said residuary real  estate  either  by
          public  auction or private contract and to stand possessed of that
          capital  of  my  said  real  and  personal  estate  and   of   all
          accumulations   or   unapplied  portions  of  the  amount  arising
          therefrom Upon Trust to divide the same in  equal  shares  amongst
          such of my sons and daughters John Richard Joseph Thomas Mary, the
          wife  of Thomas Dickinson Martha and Sarah as shall attain the age
          of twenty one years and the issue who shall  attain  that  age  or
          such  of my said children as shall die under the age of twenty one
          years as tenants in common such  issue  nevertheless  only  taking
          amongst  themselves  per  stirpes as tenants in common the part or
          share which his her or  their  deceased  parent  would  have  been
          entitled  to  receive if such parent had lived to acquire a vested
          interest therein Provided nevertheless and I hereby direct that my
          said son Richard whom I have hereinafter nominated  and  appointed
          one of the executors of this my Will shall as soon as conveniently
          may be after my decease give notice in writing to my said son John
          that I have given to him (as I hereby do) the option of purchasing
          the house shop and premises in which I now reside situate in Queen
          Street  in  Burslem aforesaid together with the goodwill stock and
          effects therewith connected and hereinbefore directed to  be  sold
          immediately  after my decease And if my said son should be willing
          to make such purchase contract and agree with my said son  Richard
          for  the  same  within  the space of one calendar month next after
          such notice shall have been so given (which contract or agreement
          I hereby authorise and require my said son Richard to  enter  into
          accordingly)  then and in such case as soon as conveniently may be
          after such contract or agreement shall be entered into a valuation
          shall be made of my said house shop premises  and  goodwill  stock
          and  effects  therewith  connected by two competent persons one of
          them to be chosen by my said son Richard and the other of them  by
          my  said  son  John and if such two persons should disagree in the
          [premises?] then by a third person or umpire to  be  nominated  by
          the  two persons so first chosen whose decision shall be final And
          then and in such case it shall be lawful for my said  son  Richard
          and  he  is  hereby  directed  and required to convey transfer and
          assign my said house shop premises and goodwill stock and  effects
          therewith  connected  to  my  said son John absolutely Provided my
          said  son  pay  within  three  calendar  months  next  after  such
          Valuation  as  aforesaid  shall  have  been ascertained the sum of
          money at which the said house shop and premises and goodwill stock
          and effects shall be so valued as  aforesaid  Provided  and  I  do
          hereby  declare  that  if my said son Richard shall refuse to take
          upon him the execution of the trusts of this my Will or shall  die
          then  and  in  such  case all and every the powers and authorities
          given to and vested in him  by  the  proviso  lastly  hereinbefore
          contained  shall  be  exercised  and  carried  into  effect  by my
          surviving children except my said son John Provided  further  that
          in  the  event of the refusal of my said son John so to purchase I
          direct that my said son Richard shall  have  the  like  option  of
          purchasing  my said house shop and premises and the goodwill stock
          and effects therewith connected upon the same terms and subject to
          the said conditions and restrictions as are hereinbefore expressed
          with regard to my said son John And in the event of  my  said  son
          Richard  declining  or  refusing  so to purchase I direct that the
          same be offered in like manner and  subject  as  aforesaid  to  my
          other sons according to their seniority And in case of the refusal
          of  all  my  said sons so to purchase the same shall be offered in
          like  manner  and  subject  as  aforesaid  to  my  said  daughters
          according  to  their seniority And in case none of my said sons or
          daughters shall think fit to  purchase  my  said  house  shop  and
          premises  and  the  goodwill stock and effects therewith connected
          the same  shall  be  sold  persuant  to  the  clause  hereinbefore
          contained  relative  to  such  sale Provided further that until my
          said house shop and premises and the goodwill  stock  and  effects
          therewith  connected  be  disposed  of as hereinbefore directed it
          shall be lawful for my said trustees or the survivor  of  them  or
          the  executors  or administrators of such survivor or their or his
          assigns to carry  on  manage  and  conduct  my  said  business  or
          businesses  in  the  same  manner to all intents and purposes as I
          myself could do if I  were  living  and  acting  therein  And  the
          profits  arising  therefrom  shall form part of my personal estate
          and be applied as hereinbefore directed I declare that  the  share
          or  interest  of any female taking under this my Will shall be for
          her own sole and separate use and bounty and shall not be  subject
          to the debts control or intermeddling of any husband with whom she
          may   intermarry   and  that  her  receipt  alone  notwithstanding
          coverture shall be a good and effectual discharge  for  the  money
          therein  authorised  [?]  to be received I give and devise unto my
          said trustees all estates vested in me as trustee or mortgagee  to
          hold  the  same  unto my said trustees their heirs and assigns for
          ever or for  all  my  estate  and  interest  therein  but  subject
          nevertheless  to  the equities affecting the same respectively And
          lastly I appoint my said sons John and Richard to be Trustees  and
          Executors  of  this  my  Will hereby revoking all former and other
          Wills by me at any time heretofore made In witness whereof  I  the
          said testator Richard Kelsall have to this last Will and Testament
          contained  in three sheets of paper set my hand this Fifteenth day
          of March One thousand  eight  hundred  and  sixty  six  -  Richard
          Kelsall  -  The  above  Written  Will  of the above named testator

          On  the 26th August 1995, I looked at "Biographical Notices 1874 -
1923"  which  is a collection of newspaper cuttings of various death notices
and obituaries of various Liverpool  "worthies",  now  microfilmed  (by  the
Mormons)  and  held  at  the  Microfilm  Unit of The William Picton Library,
Liverpool. The Liverpool Courier for Wednesday, December 7th, 1910 carried a
report of the funeral of Richard Kelsall (1837 - 1910) which stated that the
principal mourners were "John Kelsall (brother) William Beresford  and  Fred
Harrison    (brothers-in-law)."  It appears that Sarah, on an as yet unknown
date, may have married one Fred Harrison.

               MARY ELIZABETH DICKINSON n‚e KELSALL 1844 - ?

          I  have  already  noted  the  deaths in early childhood of Ann and
Sarah in 1849 and which are commemorated on  their  parents'  gravestone  in
St.John's Churchyard, Burslem. Mary Elizabeth appears to have married Thomas
Dickinson by 1864 or 1865 and had by him at least three children:

          I  have  also  copied  out  a report in "The Times" of the Divorce
case: Diver v Diver (April 29th 1908) It reads:

Divorce

          "This was the petition of Annie Kelsall Diver  nee  Dickinson  for
the  dissolution  of  her  marriage  with  Walter Diver on the ground of his
cruelty and adultery.

          Mr.Bayford said that the parties had been  married  on  June  15th
1887 at Christ Church Waterloo Sephton Lancs., and there was one child issue
of  the  marriage  [OSWALD].  The  parties had lived for many years in Great
Yarmouth, where the respondent was a man of some position, holding a  number
of appointments, inter alia, that of chairman of the Race Committee. He was,
however,  a  man  of ungovernable temper who habitually seduced his domestic
servants. This accounted for  the  difficulty  that  his  wife  had  had  in
obtaining  corroboration of his many acts of cruelty to her. On one occasion
the respondent had thrown a tumbler at his wife, and on another he  had  cut
her  shoulder  with  a  razor, the mark of which wound she still carried. On
other occasions he had assaulted  and  threatened  her,  and  she  had  also
suffered  in health through his misconduct. In 1894 Mrs.Diver had instituted
proceedings for divorce, but at her husband's request,  she  abandoned  them
and forgave him. In 1904 they went to live at Caistor and in 1905 they moved
to  London,  where they took a flat at Kensington-hill-gardens. After a time
the petitioner's suspicions were aroused by her  husband's  conduct  with  a
maidservant  named  Edith  Harvey,  especially  having  regard  to  what had
occurred with other servant girls  at  Great  Yarmouth.  Accordingly  Harvey
having  left  her  service in October 1907, she in November herself left the
flat with her son and caused observations to  be  kept  on  the  respondent.
Almost  immediately  he was found to be secretly introducing Harvey into the
flat, spending the night with her in  his  own  room,  keeping  the  servant
engaged  in conversation on the following morning while Harvey made good her
escape.

          Evidence having been given in support of the petition,  Mr.Justice
BARGRAVE  DEANE  pronounced a decree nisi with costs and gave the petitioner
the custody of her child."

          In  September '94, I wrote to a Mr. A. A. Diver of Romford, Essex,
who appears to be undertaking a One-Name Study of the Diver  Family  with  a
view to seeing if he knew anything more, especially about Oswald. I received
a  very  interesting  letter  in  return,  which,  inter  alia,  gave me the
following details about the Divers:

                 SARAH HARRISON [?] n‚e KELSALL 1850 - 18??

          It is purely speculative on my part that Sarah Kelsall married one
Fred.   Harrison  but  based  on the funeral notice for Richard Kelsall, her
brother, who died in December 1910, which refers to  a  brother-in-law  Fred
Harrison.   As  has been suggested above, unless this person is a brother of
Richard's late wife Jane E.  Kelsall,  n‚e  Balls,  then  I  suggest  it  is
reasonable  to  speculate  that Fred Harrison is the husband of Sarah. Other
than that, nothing more is known at present of Sarah or her family, assuming
she had children.

          I have already referred to the disastrous fire at Hanley St.  John
in 1842 during the Chartist Riots which caused the  destruction  of  various
parish registers. In particular, it seems that the surviving registers:

Baptisms:           1789 - 1803, 1842 - 1956
Marriages:          1837 - 1976
Burials:            1827 - 1912

inconveniently miss the marriage of John Kelsall and Martha Kelsall formerly
Ford  in  1836  as well as the baptisms of the first three children. To date
[30/8/1995] I have not checked for the younger children, nor, indeed, have I
checked the B.Ts. However, on looking at the 1992 edition of  the  I.G.I.  I
noticed  all  the events listed here. Judging by the batch reference number,
the information appears to be based on a  submission  by  a  member  of  the
Mormon  Church possibly as long ago as 1922. I suspect that as John, born in
1839 or thereabouts and who marries on Christmas Day  1864,  just  seems  to
disappear  afterwards,  it  just  may  be  the  case that John and his bride
emigrated to the U.S.A. immediately after their marriage. Perhaps  they  had
joined the Mormon Church?

          I have located in the  St.Catherines  House  Index  the  following
which I assume are references to the births of these children.

          Judging by the place of birth for the children of John and Martha,
it is clear that they must have moved to Liverpool in the 18 months  between
the birth of Henry in 1849 and the date of the 1851 Census.

          For  reasons  I discuss in the section on William Kelsall (1809  -
1833)  I  consider  that William (18) above is the nephew of John Kelsall.

          In  addition, on  the  6th July 1991, I came across the following
baptism in St.Simon, Liverpool :

          I  obtained a copy of the Will of John Kelsall (1807 - 1878) a few
years ago. It gave me useful clues about  the  link  between  John  (1807  -
1878),  William  (1809  -  1833)  Martha  (1809 - 1883) Thomas (1829 - 1889)
William (1833 - 1893). It reads:

          This  is  the last Will and Testament of me John Kelsall of Duddon
          in the County of Chester Farmer  I bequeath the wines liquors fuel
          and other consumables household stores and provisions of  which  I
          shall  die  possessed  to my dear Wife Martha Kelsall absolutely I
          bequeath all the leasehold property and other personal  estate  of

          with the consent in writing of my said  Wife  sell  my  said  real
          estate during her life in the same manner as they are hereinbefore
          entrusted to do at her death and that in the event of my said real
          estate  being  sold  during  the life of my said Wife the money to
          arise from any sale or sales thereof shall be invested in the same
          manner and held upon the same trusts as are hereinbefore mentioned
          and  declared concerning the moneys to arise from my said personal
          estate I give to my executors (as Trustees) all such  estates  and
          hereditaments  as  shall at the time of my decease be vested in me
          as Mortgagee or upon any trust subject to the equities and  trusts

          As we have seen above, according to the  Will  of  Thomas  Kelsall
(1799-1839), Thomas had a brother, William, who was already dead by the date
of  the  Will   (9  Apr 1835). This corresponds to the death reported in the
Staffordshire Advertiser for  the  7  Dec  1833  of  a  William  Kelsall  of
Piccadilly,  Shelton, Stoke. William's Will was witnessed and signed by John
Kelsall and a cursory inspection of both William  and  Thomas's  Wills  show
that  the  2  signatures of "John Kelsall" are the same, hence corroborating
the already strong case for saying that all three are brothers.

        I   have   found   in   the  Marriage  Register that William Kelsall
married Martha Ford of Stoke at Stone St.Michael's Parish Church on the 29th
September 1828.

          For reasons already mentioned, it is unlikely that any baptism  of
these  children  will have survived the fire at Hanley. Again, I have yet to
check the B.Ts.

          The Staffordshire Advertiser reported William Kelsall's death:

          hereinafter mentioned that is to say. First upon Trust to pay  and
          discharge  my debts funeral and other expenses from and out of the
          first money belonging to my Estate which shall or  may  come  into
          their hands Then upon Trust that my said Executors and Trustees or
          the  survivor of them do take an inventory and valuation, or cause
          to be taken such Inventory and valuation of all  and  Singular  my
          Household  Goods  and  Furniture  hereinbefore  mentioned,  but to
          permit and allow my Dear Wife Martha Kelsall to have and enjoy the
          free and uninterupted use of them for and during the full term  of
          her  natural  life  and  remains  unmarried  And also that my said

          whether  at  Interest or otherwise and also collect my outstanding

          securities, and pay over the said Interest money  by  half  yearly
          payments,  to  my said Wife Martha Kelsall for and during the term
          of her natural life and remains unmarried But should my said  Wife
          Martha  Kelsall  marry  again or live an incontinent life. Then my
          Will and mind is that her use and enjoyment of my  said  Household

          One significant feature of this Will is the reference to William's
uncle William Ratcliffe, which lends weight to the marriage noted in 1799 of
John Kelsall to Elizabeth Ratcliffe as being the correct marriage.   I  have
not,  as  yet,  looked  for  any  Wills  of Ratcliffes which might assist in
showing this and perhaps other family links.

          It  would appear to be the case that there is no  surviving record
of Joseph Kelsall's baptism. I have searched the  PRs  for  various  of  the
parishes  in  the areas of Stoke on Trent, in particular, the parish of Lane
End under the name Kelsall or Kelso but without success. I have also  looked
at  the BTs for Lane End Parish Church to double check the micro-film of the
PR. It is to that extent more than possible that, together with his  missing
sisters,  Joseph  was baptised at some other parish or perhaps in some other
denomination, but marries within the Established Church.

          I  am satisfied that the Joseph Kelsall who figures  in  the  1841
Census for Vine Street, Shelton, Stoke on Trent (P.R.O. ref.: HO 107 992) is
for this Joseph Kelsall together with his parents and cousin William:

 CHESTER CHRONICLE AUGUST 4TH 1866 

FATAL ACCIDENT - Mr.Kelsall fishmonger of the New Market with his uncle, Mr.
Joseph Kelsall, his brother, and a young  cousin,  were  driving  along  the
railway  bridge  to  the goods station on Thursday evening, when, on passing
the kerb stone at the gates the vehicle was overturned and the whole of  the
occupants  thrown violently to the ground. Mr. Joseph Kelsall sustained such
severe injuries that he died in a few minutes after the accident.  The  rest
of the party were not much hurt. An inquest on the body of the deceased will
be held this morning.

          On the 20th May 1995, I  looked  at  the  microfilm  copy  of  the
Staffordshire   Advertiser   and   saw  quite  a  different  story,  one  of
drink-driving...

INQUISITION:

AN  INQUISITION  indented,  taken at the Infirmary in the aforesaid City and
Borough, the fourth day of August in the thirtieth Year of the Reign of  our
Sovereign  Lady  VICTORIA,  by  Grace  of God of the United Kingdom of Great
Britain and Ireland, Queen, Defender of the Faith, before me, JOHN  HOSTAGE,
Gentleman,  Coroner  of  our  said Lady the Queen for the aforesaid City and
Borough, upon view of the Body of Joseph Kelsall then and there lying  dead,
upon the Oath of Henry Wilbraham, Joseph Jones, Charles Thorpe, James Jones,
James  Smith,  Samuel  Meacock  Junior, Thomas Ellis, Thomas Bellis, George
John Hensley Brown, William Conway, Henry Morris and  David  Williams  good
and  lawful  Men of the aforesaid City and Borough, who being then and there
duly Sworn and Charged to Inquire on the behalf of our said Lady the  Queen,
when,  where,  how,  and  by  what means the said Joseph Kelsall came to his
Death, do upon their Oath say that the said Joseph Kelsall on the second day
of August in the Year aforesaid, at the aforesaid City and Borough, was in a
spring  cart  then  and  there being driven by one Thomas Kelsall when it so
happened that one of the wheels of the said  cart  caught  against  a  stone
placed  to protect a door post at the entrance of the goods warehouse of the
London and North Western Railway Company thre situate and the said  cart  was
thereby then and there accidentally casually and by misfortune upset and the
said  Joseph  Kelsall  was  thrown  from  the said cart and sustained divers
injuries from the shock whereof the said Joseph Kelsall on  the  said  second
day  of  August  in the year aforesaid at the city and borough aforesaid did
die _____ And so the Jurors aforesaid, on their Oath aforesaid, do say  that
the  said Joseph Kelsall in manner and by the means aforesaid, accidentally,
casually, and by misfortune, came  to  his  Death,  and  not  otherwise.  IN
WITNESS  whereof, as well the aforesaid Coroner  as  the  Jurors  aforesaid,
have to this Inquisition set their Hands and Seals, the Day and Year, and at
the Place first hereinbefore written.

Last Will and Testament:

          Joseph  Kelsall had made a Will on the 12th December 1865 in which
he mentions by name his wife Mary Ann but not those  of  his  children.   He
appointed  two  friends  to  be  the  executors  of his Will, namely Richard
Langley and George Olivant.  For some reason his friends  renounced  Probate
and  a grant of Admon with Will attached was granted to his widow, Mary Ann.
By 1878 a further Grant of Admon with Will was issued out of  the  Lichfield
District  Registry  to  his  son  Thomas Kelsall (yet another fishmonger...)
presumably on the death of Mary Ann.

          This is the last Will and Testament of me Joseph  Kelsall  of  the
          Borough  of  Hanley in the County of Stafford Fishmonger made this
          twelfth day of December 1865 in manner & form following  (that  is
          to  say)  In the first place I direct payment of all my just debts
          funeral and Testamentary and the expences of proving this my  Will
          as  soon  as conveniently may be by my Executors hereinafter named
          and subject thereto I give devise & bequeath unto Richard  Langley
          of Piccadilly Hanley afsd. Ironmonger and George Olivant of Hanley
          aforesaid Publican All my real and personal Estate Upon  trust  so
          far  as  relates  to my personal Estate to permit my wife Mary Ann
          Kelsall she continuing my Widow to carry on the Trade or  business
          in  which I shall be engaged at my death & use and employ for that
          purpose such part of my personal estate as shall be then  used  or
          employed  therein  I  direct that my Trustees shall permit my wife
          she continuing my ww personally to occupy  as  her  residence  the
          Messuage wherein I now reside at the Borough of Hanley afsd And to
          use  therein  my  household furniture utensils plate linen china &
          consummable stores she keeping  the sd.  Messuage  in  repair  and
          paying  the  expense  of  insuring the same from loss or damage by
          fire And also the Taxes & other outgoings  affecting  the  same  I
          direct  but  subject to the previous dispositions that my Trustees
          shall convert my personal Trust properties and invest any  surplus
          after paying my debts at interest on Government or real securities
          And  I  direct  my Trustees shall permit my wife she continuing my
          widow to receive from my death the net  annual  income  proceeding
          from  my  Trust  property however constituted or invested I direct
          that my wife during her widowhood shall out of the  income  to  be
          received  by  her persuant to the last clause maintain & educate &
          bring  up  my  children  I  direct  that  my  Trustees  with   the
          concurrence  of  my  wife  &  should she be dead then of their own
          discretion may by Mortgage of all or any part of  my  real  Estate
          raise  such  sum or sums of money for each Child obtaining the age
          of 21 as they or he may think proper not exceeding the sum of #100
          each and should my wife die or  marry  again  before  my  youngest
          Child  obtains  the age of 21 years then and in such case I direct
          my Trustees to apply the whole such rents interest and proceeds in
          maintaining educating and bringing up such of my Children as shall
          be incapable of maintaining themselves And on the death or  second
          Marriage  of my said Wife & the youngest Child having attained the
          age of 21 years  I  then  direct  that  my  Trustees  shall  stand
          possessed  of  all my residue real & Personal Estate Upon trust to
 C.S.     sell & convert the same into money either  by  Public  Auction  or
          private  contract  with  power to rescind all or vary any contract
          and whose receipts shall be  absolute  discharge  for  all  monies
          under  my  Will  Upon  further  Trust  to  divide the same equally
          amongst such of my Children as shall be then living share &  share
          alike  and  to  such  of  them as shall be dead leaving issue such
          issue shall take their deceased parents share in equal proportions
          I devise all Trust Estates vested in me at the time of my  decease
          To  my Trustees Upon ye like Trusts I could have held the same had
          I been liveing I  direct  that  purchasers  &  others  taking  the
          receipt of my Trustees on paymt.  or transfer to them of any money
          or  effects  shall  be exonerated from all liability in respect of
          the applicon.  thof.  I Direct that my  Trustees  may  deduct  and
          mutually  allow  to  each  other  all  disbursements  and expences
          incident to the execution of my Will and shall be responsible each
          for his own acts and defaults only and  irresponsible  for  losses
